ISPs that throttle/interfere with BitTorrent

TalkTalk in the UK are throttling : http://www.talktalkmembers.com/content/view/58/68/ With TalkTalk i'm signed up to a 40gb per month download limit, so how can they have the cheek to throttle me? surely i'm only infringing on other talktalk user bandwidth if i go over my agreed limit? BTW I love the way the call it " Traffic Shaping".
