Can't restrict upload limit

I'm running vista ultimate 64 with NOD32 antivirus and have tried recently to limit the upload speed with no result . I set it anywhere from 1 - 50 KB/s and it will still max out at around 90.

options, preferences, bittorrent, limit local peer bandwidth
