lose dial tone on phone modem

I have comcast digital phone and internet d/l speed around 6meg. up around 1.8-2meg since i upgraded utorrent to the newest version 1.7.2 i lose my dial tone when my upload speeds reach around 200k, could be a bad modem but just very strange this happened the first instant i upgraded utorrent. also running a speed test at the time of using utorrent my d/l drops to 800k and up drops to 30. (but utorrent is d/ling and up-loading at great speeds) if i limit upload speed to 100k or so phone line is fine. i was just wondering if anyone else had experienced this problem.
