Optimum Online totally disconnected my uploading?

Hello, I am currently under the ISP Optimum Online, with the package Boost which gives me 30mbits download, and 5mbits upload.

Before I got boost, about a few months ago, I was uploading max speed (250kbps on a 2mbit line) for a good month uploading a total of 160gb and downloading 70gb. My speeds since then have been determined by pure randomness and the scent of throttling. For instance some private tracker torrents have been starting at 15kbps then dropping to 10kbps then to 2kbps, then to .5kbps then finally disconnecting. While other torrents at different times have been uploading to their full potential, and some inbetween. Many other places have concluded I am being throttled. How is that so when other sites after waiting around 20 minutes the peer finally connects to me and grabs the files with full speed? I have done a TCPview and most connections coming inward are labeled with "TIME_WAIT" and my uTorrent logger shows the following:

My max half open connections is set at 4, though I have tried patching the TCP.sys nothing has seemed to change my upload rate. I have also tried calling them up, numerous times they have said I am not capped, and a speedtest reports fullspeeds as advertised. I decided to upgrade to boost.

Although nothing has changed but my download rate, I have uploaded a few private torrents to my tracker and let a few friends grab it, surely enough after 20 minutes of no activity my upload shoots to 400kbps.

Is there anything I can do to fix this? I have read as much as I could find; to no avail.
